About these terms
These terms apply when you browse openAddress, send an enquiry, contact us or submit a property for advertising. By using the website, or by ticking the consent boxes on the listing form, you agree to them. If you do not agree, please do not use the website. Our privacy policy explains how we handle personal information.
The service
openAddress is a free advertising platform for Australian residential property for sale. We do not act as a selling agent, negotiate sales, hold deposits or provide valuation, legal, tax or financial advice. We charge no listing fees, subscriptions or commissions, and browsing and enquiries are free. Costs you choose to incur elsewhere, such as photography, a sales agent or a conveyancer, are between you and those providers.
Who can use the service
You must be at least 18 years old. Property owners and authorised agents may advertise. If you advertise as an agent, you confirm that you hold any licence or registration your state or territory requires and that the property owner has authorised you to advertise it.
Advertiser responsibilities
You must own the property or have authority to advertise it, provide accurate and current information, use a genuine and lawful price guide, and have the rights to everything you upload. You are responsible for following Australian consumer law, including the rules against misleading or deceptive conduct, and the property advertising and price-quoting rules of the state or territory where the property is located. Do not publish photographs or details that identify tenants or other people without their permission. Promptly tell us when information changes or a property sells.
Rental and investment information
Where an advertiser supplies rental details, such as whether the property is tenanted or vacant, the weekly rent or when a lease ends, the advertiser is responsible for those details being accurate and current, and must have reasonable grounds for any figure they give. We do not verify rental details. Any yield we display is an estimate: annual rent divided by the lower end of the price guide, before costs such as rates, insurance, maintenance, vacancy and management fees. It is not a forecast, a valuation or financial advice. Buyers should check leases, rent history and all figures independently.
Review and publication
We review submissions before publication and may ask for evidence of authority. Review is not a guarantee of accuracy, ownership or transaction safety. We aim to review submissions within 24 hours but do not guarantee publication or any number of enquiries. We may refuse, correct, unpublish or remove a listing that is misleading, outdated, unauthorised or otherwise unsuitable, and we will usually tell the advertiser why.
What you must not do
Do not use openAddress to advertise something you do not have authority to sell, to post false, misleading, defamatory, discriminatory or unlawful content, to upload images you do not have rights to, or to publish other people’s personal information. Do not send spam, scams, harassment or malware, collect or scrape personal information or listings in bulk, overload the website, or try to bypass its security, bot checks or rate limits. Do not copy the website’s design or content for another service without our written permission.
Your content
You keep ownership of the content you submit. You give us a free, non-exclusive licence to host, copy, resize and display the approved listing and its photographs on this website while the listing is active, and to keep records of it as described in the privacy policy. You confirm that you have the right to give this licence and that your content does not infringe anyone else’s rights. We will only feature your property, using its photographs and details, in YouTube videos or social media posts, on our own accounts and our affiliated accounts, if you tick the optional promotion permission on the listing form. You can withdraw that permission through the contact form at any time before the video or post is published.
Our content and intellectual property
The openAddress name, logo, design, text and software belong to the operator or its licensors. You may view and share links to the website for personal or ordinary business use, but you may not otherwise reproduce or reuse them without permission.
Buyer responsibilities
Independently verify property details, ownership, advertiser authority and transaction terms. Arrange appropriate inspections, contract review and professional advice. Do not send deposits, bank details or identity documents through this website. Map markers may be approximate and do not show a property boundary.
Enquiries and communications
Enquiries must relate to the advertised property. When you send an enquiry, we pass your name, email address, message and optional phone number to the advertiser so they can reply. We are not a party to any conversation or contract between buyers and advertisers, and we do not guarantee that an advertiser will respond.
No advice, and third parties
Information on openAddress is general and is supplied by advertisers. It is not advice. The website may link to or rely on third-party services, such as maps, and we are not responsible for those services or for other people’s websites.
Disclaimers and limits on our liability
We provide the website on an “as is” and “as available” basis. To the extent the law allows, we do not promise that listings are accurate, complete or current, that the website will be uninterrupted or error-free, or that any property will sell or any buyer will be found. To the extent the law allows, we are not liable for any indirect or consequential loss, or loss of profit, opportunity or data, arising from your use of the website or from dealings between users. Nothing in these terms excludes, restricts or modifies any right or guarantee that cannot lawfully be excluded under Australian law, including the Australian Consumer Law. Where our liability cannot be excluded, it is limited as far as the law allows.
Indemnity
If you submit a listing, you agree to cover reasonable losses and costs we incur because your content, or your breach of these terms or the law, leads to a claim by someone else.
Suspension and removal
We may remove a listing, refuse access or block a user at any time if we reasonably believe these terms have been breached, a listing is unlawful or unsafe, or we are required to by law or a regulator. You can ask us to update or remove your listing at any time through the contact form.
Reports and complaints
To report a suspicious or unlawful listing, an error, or a possible infringement of your rights, use our contact form and include the listing link and what you are concerned about. We may verify your identity or authority before making changes and will review reports promptly.
Availability
Service availability depends on third-party providers and their usage limits. We may change, pause or discontinue features, or the whole website, and will try to give reasonable notice where practical.
Governing law
These terms are governed by the laws of the Australian state or territory in which the operator is based, and you agree to the non-exclusive jurisdiction of the courts of that state or territory and the Commonwealth.
Changes to these terms
We may update these terms from time to time. The current version is always published here with its date, and material changes will apply from when they are published. Continuing to use the website after a change means you accept the updated terms.
Contact
Questions about these terms can be sent through our contact form. The final version will include the operator’s legal name and contact address.
